OPERATIONS • The Rotary Club of Mason agreed to lead fundraising efforts in November for the $20,000 required for the adoption and training of a sheltered dog for a K-9 Program for the City of Mason. As of 12.3.20, the Rotary had less than $2,000 remaining to raise to meet the goal. Our team is so appreciative of our generous community and their support of this initiative. • Canceled: Capital Area District Library – Mason Branch’s Holiday Reindeer Event, December 10, 2020 in Rayner Park. • Administrative approval has been given to New Wine Church for their Over the River event on December 13, 2020. This event will be held on the Hayhoe Riverwalk Trail with different stations along the trail. • Surveys have been sent out to all property owners and contractors that pulled building permits in the last two years. We are asking for feedback on their experience to learn how we can improve services in the future. The survey is available here - mason.mi.us/buildingsurvey. • City Hall operations will be closed between Christmas and New Year’s, as in previous years to allow our employees to spend time with their families. This continues to be one of our most appreciated benefits and after this stressful year, it is even more deserved. Essential operations will continue and members of our leadership team will be available to respond to any urgent issues. • 410 E Maple Update: The property is owner is currently waiting for the engineering firm she hired to provide a report on their findings. She will share that with us as soon as she receives it and the firm we hired will review to determine if there is any information that would change his original opinion. • Rayner Park Grant Applications: We received notification within the last week that we were not awarded grant funding for the Rayner Park Playground from the three programs we applied for. We will take the time to meet with the State to get feedback on our applications and how we can be more competitive for future rounds. Staffing Updates: • Open Positions – Seasonal Crossing Guard position posted and is open until filled. • Resignations – Rob Mentink voluntarily resigned as Corporal, effective November 13, 2020. Traffic Updates: • Columbia Street at US 127 Overpass - Traffic congestion turning difficulties. Staff is working with MDOT for possible changes to the signal timing. An officer has been assigned to monitor the situation and be a liaison. • Rodgers Street and Cherry Street – Stop Sign Violations. Officers have been assigned for additional police presence and targeted enforcement. 55 LARGE CITY PROJECTS FY 2019-2020 Project Project Name/Description Status Completed UTILITIES: SANITARY SEWER, STORM WATER, AND WATER DISTRIBUTION (U) 2017-U11 Turbine Aeration Blower at POTW Estimated time of arrival of April 2021. From: Deborah Stuart Subject: City Council: Supplemental Information for Tonight"s meeting Date: Monday, December 7, 2020 4:21:24 PM Greetings City Councilmembers: We have received the questions below related to tonight’s agenda. I’m happy to expand or go through these at the meeting in more detail, if needed. Questions related to the packet: 1. BILLS: What is the final cost for Kerns Rd.? Including all construction, engineering, land acquisition, surveying, fees, permits and any and all other costs related to the project. This would include all costs related to the swale on Kinder’s property. Total Initial Budget including Trail - $1,104,672.34 Initial Contract Construction : $936,163.00 approved by Council on 7.17.19, Actual $936,163 Balance is 18% additional for Engineering costs, Actual Paid approximately 13%- Not complete Only Change Orders (Related to Kinder Property): Easement Cost: $21,960 approved by Council on 8.5.19, Actual $21,960 Change order for Storm Water Runoff: $69, 665, approved by Council 8.17.20, Actual $69,665 2. MANAGERS REPORT: I was bummed to hear we didn't receive the Grants needed for Rayner. I know I am not alone in that sentiment. Is their enough time to include a reminder of grants we have applied for and the outcome over the last four years in a supplement email to council tomorrow? This would take considerable staff effort to gather information on all grants that we apply for annually. I would estimate there are 30-40 applications for various things every year. We could provide a report in January or at budget time regarding the grants we received in the last four years. 3. MANAGERS REPORT: In reviewing the Continuity of Operations doc I see it still says city hall is open MWF but I believe that is not the case right now. Yes, this is incorrect, the updated version can be found here: https://www.mason.mi.us/COVID- 19/Continuity%20of%20Operations%202020%20rev.%2012.7.20%20FINAL.pdf In the Preparedness doc: 14 days is noted as quarantine time but that time is now 10 days now according to the CDC I thought. The quarantine period has not been changed in Ingham County yet. We have received word that the Ingham County is likely going to switch to 10 days any day. It is important to note, the CDC still recommends 14 days. The new change is that they gave public health officials options for the 10 day or 7 days with test. Ingham has confirmed they will not go to 7 days, even if the state considers it. We have been told they feel that many of the cases can be handled using the 10-day option, but not all and best practice is still 14 days, so we are still evaluating. For example, if it was a household exposure 14 days will likely still be needed. However, a one-time exposure, 10 day may be appropriate. 4. MANAGERS REPORT: The link in the Manager’s Report for the building permit survey does not work for me. Updated link here: https://www.surveymonkey.com/r/8FQF8WC Questions from Council on issues not specifically related to packet: 1. We haven’t had a report from the ethics sub-committee which I believe are Russ, Marlon, and Jerry. Where do we stand there? The City Attorney and I have reviewed a proposed draft of the ethics ordinance changes and they are meeting with the Board of Ethics group this week, but I would defer to the members to give any other update at the meeting. 2. We are we as a city in the process of placing a marker in memory of Jonathon Taylor (the young man who was lynched in 1866)? This action came before the cemetery board before COVID and the individual was instructed that if they wanted public property donated, it would have to go before City Council. If they were interested in purchasing a lot, they could do that for the placement of the memorial. I don’t believe any other action has occurred since that time. 3. The city limit sign on the south end of Jefferson St, down towards Kipp Rd. is looking a little shabby. Could someone look at it and perhaps freshen it up to make it look inviting for visitors? Thank you. It is on our radar; we hope to send it off to the sign shop in the next few weeks. It will be done for a bit while they work on it. 4. The steps on the corner of Maple and Rogers have become a dangerous situation. What can be done about that? It looks like a liability problem. Our team starting looking at these last summer to figure out a solution. The best temporary solution was filling holes with cold patch. Unfortunately, the long-term solution is very costly since any change would be require for it to meet ADA requirements. We are getting quotes to replace only the steps only and may still be able to do that within our sidewalk budget this year. 5. Please provide me with a list of positions and compensation, including pay & benefits for those positions in both the fire and police departments. I’m not sure what you are asking for, since I cannot provide compensation including benefits by position only be individual due to personal situations of the individual (do they have a family or single, for example). Here is general information that may help, but additional information could be provided during budget process if needed. Fire is paid through a complicated structure: Base Pay of $1,100-$358 depending on position, Meeting/ Assignment $10, Runs $11.50/ hr, Incentive Points (volunteering in community for example) $10/ pt up to a total of 156 points for department. Depending on the number of responses and involvement, their individual pay will vary. The exception to this pay structure are the Fire Chief and the Admin Assistant. Police. Majority of the employees are covered under the contracts you just approved that outline salary and benefit. The only employees not covered under the contracts are the Chief, Admin Assistant, and Specialist. Resources that might help with benefit questions can be found here https://www.mason.mi.us/city_departments/city_clerk___human_resources/index.p hp#outer-127sub-676 at the bottom under Personnel Resources. It outlines all of our benefits for union and non-union. Please note that Police have not been updated yet, since the contract just got signed by all parties, but you should have the contracts from our last meeting. These responses will be added to the packet on the website for future reference. One had the potential of a working K-9, which the Mason Police Department (MPD) has been considering for years. About 30-40 calls a year in Mason occur where a dog could assist. The dog was evaluated by experts. All have concluded that the dog would be a great fit for a K-9 program with additional training. A current employee will be competitively selected through an internal process and be enrolled in the training with the dog. No staff will be added. Due to uncertainty of City finances, Mason City Council will only authorize the adoption if funds are raised to cover the startup of the program so there will be minimal burden to tax payers. The Rotary Club of Mason has agreed to take on that challenge. THAT IS WHERE WE NEED YOUR HELP! Donations can be received by the Rotary Club of Mason by mail at PO Box 101 Mason, MI 48854-0101. 201 West Ash Street; Mason, MI 48854-0370 Office: 517.676.9155; Website: www.mason.mi.us LEAF COLLECTION PROGRAM LEAF COLLECTION: The Leaf Collection Program is a limited service designed to supplement yard waste collection provided by Granger. Removing the fallen leaves helps to prevent ponding, flooding, and road icing as a result of blocked drainage paths and catch basins. As a service to our residents, City staff collect leaves in the right of way during this specific time. You can help the City clear the autumn leaves by raking leaves that have accumulated in your front yard out to the right of way, no more than a few days before your street’s collection day; see the Zone Map below. Please do not rake leaves onto sidewalks, roadways, on top of catch basins, or obstruct water flow in any way. Improperly placed leaves may cause them to be missed during the pick-up day and can create dangerous conditions for pedestrians, cyclists, motorists, and may create flooding conditions. All other leaves (like those from side and back yards) should be placed in either disposable paper bags or in trash cans, 30-gallon or smaller, and placed at the curb on Fridays. Granger will accept up to 5 bags or cans weekly from each residence until November 20, 2020, as part of their service with the City. LEAF COLLECTION SCHEDULE AND ZONE MAP: Collections will be mid to late October through November 20, 2020. Pick-up days are coordinated by the Zone in which you live. If you see City staff in your area a few days earlier or later than scheduled, they are just getting an early start or making a final collection pass in your area. Please understand that snow accumulation and other weather-related events may impact the City’s ability to run the program. COMPOST CENTER: The Compost Center is available for anyone who would like to pick-up compost or drop off leaves; brush and limbs are not accepted. It is located at 862 Mason St. and will be open Saturday, October 24, 2020 through Saturday, November 21, 2020; Monday – Friday 8:00 a.m. to 3:00 p.m. and Saturday 8:00 a.m. to 12:00 p.m.; closed on Holidays. Convention Agenda • We currently have 2,620 voters who have requested an Absentee Ballot for the November 3, 2020 General Election. All returned Absentee Ballot envelopes will have pre-paid postage on them to allow for easy return for voters. Ballots were mailed on Thursday, September 24, 2020. They will be mailed daily thereafter. • As part of the CIP, staff will be proposing a modification to the Masterplan Update. Instead of phasing over a period of three years, staff will propose the schedule will be reduced to two phases and be coordinated with corridor planning projects for efficiency. • The City Manager was nominated to serve on the MML’s 19 Member Board of Directors and will be sworn in on September 29, 2020. 62 201 West Ash Street; Mason, MI 48854-0370 Office: 517.676.9155; Website: www.mason.mi.us • The City of Mason applied for the First Responders Hazard Pay Premiums Program and was awarded $44,000 to pay qualifying first responder hazard pay premiums of $1,000 to first responders who have performed hazardous duty or work involving physical hardship related to COVID-19 and will be making payments to qualified employees by October 31, 2020. • The City of Mason is opting out of the payroll tax holiday approved August 8, 2020 by President Trump to defer the collection of the 6.2% payroll tax contribution (paid by employees) which partially funds Social Security. The reason for opting out is that this Executive Order is only a deferral (consider it a “loan”) thus employees would have to pay double in 2021. • At this time, due to COVID-19 restrictions, the annual City Open House has been canceled. • Rayner Park DNR Grants: We have received preliminary scores for the three grants submitted to the DNR for Rayner Park Improvements. Staff is working to address comments from the DNR asking for more information. From: Bcc: Subject: Date: Attachments: Deborah Stuart City Councilmembers City Council 9.14.20: Supplemental Questions and Materials Monday, September 28, 2020 4:04:00 PM 9.28.20.CC.1a Agenda, RW Approved FINAL.docx 9.28.20.CC.7.C.1 SAR Maple Home Update FINAL.docx Greetings: Please find the attached updated agenda and supplemental materials. These will be added to the website materials. We also received some inquiries about tonight’s agenda: ITEM 5.C.1. The payment listed for Karen Kinder concerning the Kerns Rd easement. Is the payment shown the total payout for Ms. Kinder? Yes, this is the total payment agreed to by Council, as indicated in email supplement to last meeting. What is the total for all related costs for the easement and swale purchased for the Kerns Rd project? As mentioned in last communication before Council on 9.14.20: Easement Cost: $21,960 approved by Council after Closed Session on 8.5.19 Change order for Storm Water Runoff: $69, 665, approved by Council 8.17.20 How many lead & copper service replacements were completed by Reith-Riley for the $17,650.00 payment? This was a partial payment. One lead service line was repaired in the $17,650 payment, the remaining cost is related to removal costs and restoration costs of all the repairs. 14 lead services were replaced over the contract at an average cost of $4,500 per line, the remaining cost is related to removal costs and restoration costs of all the repairs. How many replacements are left to be done? None for this year. How is each replacement cost determined? There are six specific line item unit costs per task required to remove and replace the lead service lines. These Units are Excavating, Disconnection from Watermain, Install New Service, Install Corp/Curb Stop/Tap/Box, Connect Existing Service Line at House, Landscaping. Costs per line can vary due to the specifics of the property. There are also other costs associated with service line replacement that are not provided by Reith-Riley. ITEM 7C Where does the City stand in the investigation concerning the property at 410 E. Maple? Will this subject be discussed at the meeting on The 28 th? Update will be provided under this agenda item, but please note the agenda item will be amended to only be an update. Updated agenda and attachments are attached. They will also be updated on the website. ITEM 8A/B: Does the City have clear title to the library building? I remember discussions concerning who actually owns the building and I would like to be sure that the City has clear title before we put any money into the building project. I believe you are referring to the deed restriction. Please note the information under additional actions required in the memo. This item will be addressed prior to spending any funds on construction. Is the City’s total commitment for the Library capped at $275,000? At this time the goal is to cap the City’s contribution at $275,000. Please note the Council originally agreed to support a budget of $550,000 for the library renovations for Phase I with a goal of raising half of the costs through grants and fundraising. This was delayed due to COVID, but the project remains the same. This grant will help facilitate that goal. However, the agenda item outlines that even with this grant we still have to raise an additional $175,000 to meet the goal for fundraising. We have split it Phase I to allow us additional time to raise funds for the remaining portion of this project, but there is no guarantee we will raise all funds required or the that the project costs will not change and the city will not have to contribute more. ITEM 10: · Concerning the Rayner park DNR grants: Are there designs, drawings or specifications of what the play structure will look like and the materials that will be used in the construction of the play structure? If so, when will the Council see these and when will the public have access to them? Have specifications/drawings for the play structure already been considered or approved? Is Lumbermans going to be the contractor? Will the public be asked to participate in the process of design or building of the play structure? There will be additional public meetings/participation after grant award is announced. We are obligated to observe those items as described in the conceptual documents submitted in the grant. What we have committed to is consistent with what was approved in the parks, recreation and non-motorized plan – addressing condition of the playground equipment and bringing it into a state of good repair, and elevating the ADA score. Choices for playground surface and play equipment must meet the criteria for ADA accessibility and have a useful life of at least 20 years (routine maintenance sufficient without major repair/replacement). The public has access to everything we have submitted to date at the City’s webpage - click here. Staff is working on addressing comments and supplemental documents required by DNR prior to Oct 1. Once those are complete, staff will add to website so that the public has access to everything staff has submitted. We do not have a finalized design or contractor for the project. Council would have to approve both of those prior to moving forward. Beyond the DNR grant/playground, there will be a separate planning effort for the remainder of Rayner Park – bathrooms, fields which will be discussed in the CIP. These questions/answers will also be added to the packet. BUILDING, PROPERTY, EQUIPMENT (B) 2019-B16b Clerk: Election Tabulator Machines Council approved July 20; in process 37 August 11, 2020 To Whom It May Concern: I am writing this letter today because I can no longer trust that the issue will be addressed informally. I completed a remodel of my home in the 1980’s. This remodel utilize the same footprint of my slab home and with approvals and permits we added a crawl space and a second floor onto the west side of my home located at 410 E. Maple Street in the City of Mason. The home has a storm drain on the west side of the property between the street and the back of the lot. There also is a manhole cover at the corner of the rear of the west side of the home which supposedly was an abandoned sewer/storm drain. And, another manhole cover in the back of my neighbor’s lot approximately 10 feet from the other manhole cover. The home was completely on a slab until this remodel and the main portion of the home still is. There was problems almost immediately. I was told when the permits were drawn up that there was an abandoned storm sewer beneath the home. We started getting water into the crawl space so significantly that I had to move and eventually replace the boiler that was in the crawl space. At my own expense. Pierce Plumbing was our contractor. The lot often floods and at one point in 2016 the water reached the base of my door on the outside and almost to the front door. My crawl space was flooded to the floorboards. But, no water actually made it into the home. I called the city immediately and they inspected the drains. Cameras were inserted and I was told there was a broken drain. To date it has not been fixed. I called last year and was told it “was not in the budget to repair”. I have worked with the City of Mason Public Works when these incidents occur. Over the years it usually was a blockage or broken drain that was claimed to be the problem. I am no longer confident that the proper city officials are aware of this ongoing problem and without knowledge a solution cannot occur. What has triggered this letter, you may ask? About a month or two ago I noticed a sink hole in the back of my home. I had noticed my back door wouldn’t open and that my stairs were uneven. Now my door to my laundry room won’t close. I contacted the city immediately when I noticed the sink hole. Someone came and dug up the manhole cover which next to the rear of the home by that door. The manhole cover had sunk at least nine inches and remains dug up. The ground is sinking around it. And, I have discovered thirteen mini holes (honeycomb fashion) between that manhole cover and the storm sewer in the middle to lot. This has tripled in number over the last two weeks. The largest is the size of my foot. 38
The city sent someone to “blow out the drain”. I called to find out what was found out and was told that the drain is blocked and that they are considering blocking the storm sewer. However, in order to do this a study needs to occur to determine if blocking the drain will cause further back up along the line of the drain and thus cause problems for other city residents. Now remember this drain was supposed to be abandoned. I was told that they are talking to an “old timer” to see if they could figure out the history of the storm sewer that supposedly runs under the home. I discovered once the sink hole became larger that there was a separation of the house from the foundation. And, that there is now inches of clay in the crawl space. There are fresh cracks in the walls of the crawl space. The sink hole is no 5 feet by 2 feet 5 inches. There is a big problem. I contacted two foundation specialists to survey the damage and let me know how to fix it. John Pollack from Everdry Waterproofing, 616-406-0808 came to my home on 7/10/2020 and Christopher Johnson, from Foundation Solutions 360, 616-859-8882 came to the home on 7/11/2020. Both concluded the following: There was improper maintenance of the water which has resulted in structural damage. There was a failure to respond and remedy the situation over years of contacting the city. This failure to respond has now caused the footing to collapse and resulted in $20,000 of damage. To complicate matters, work cannot begin until the problem is fixed and resolved. Neither company will do the work. Both companies put blame the city for lack of mitigation of the city storm drainage system. There is water entering the south eastern corner of the crawl space. One contractor told me there is definitely water coming from somewhere in the southeast corner, as well. I have contacted my home owners and flood insurances. At this time, it does not appear that they will be covering any portion of the repairs. Public Works offered to fill the hole – however – I believe this would just end up in my crawl space. I asked for a construction fence be place to prevent children from entering that area. This was done in the last week or so. Therefore, I am asking the City of Mason to contact their insurance company and to develop a solution to fix the problem. I request that the solution be forwarded to me within the next 30 days. Respectively, Jean M. Karslake Lifelong Resident 410 E Maple Street Mason, MI 48854 517-974-7675 CC: City Manager Mayor City Council Department of Public Works 39
